for the use and purchase of the “Barcode Medic” software

§ 1 Scope and Provider

  1. These Terms and Conditions apply to the use of the “Barcode Medic” web application (free tier and full version) and to the purchase of licence keys for the full version.
  2. The software is provided by Cayan Oyman, Ramsener Straße 43, 78239 Rielasingen-Worblingen, Germany, [email protected] (the “Provider”).
  3. For the purposes of these Terms and Conditions, a consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or self-employed professional activity (§ 13 of the German Civil Code, BGB).

§ 2 Conclusion of the Contract and Payment Processing

  1. For purchases labelled “Sold through Link” at checkout, payment is processed through Stripe Managed Payments. Sold through Link, LLC acts as the Merchant of Record for payment and tax processing. Cayan Oyman remains the software provider and your contact for delivery, usage rights and product support. The Link terms linked at checkout also apply to the payment transaction. For earlier Gumroad purchases, the corresponding purchase documents and activation methods remain applicable.

  2. These Terms and Conditions govern the relationship between the Customer and the Provider in relation to the grant of rights to use the software (§ 4) and the provision of the application.

  3. After payment is confirmed, we provide the licence on your personal confirmation page and send it to the email address supplied with your purchase. You can use licence recovery to request another licence email for an eligible Stripe purchase. For earlier Gumroad purchases, the existing redemption pages for the respective applications remain available.

§ 3 Description of the Service

  1. Barcode Medic is a browser-based application for preflighting barcodes in print files: it locates barcodes in a file opened by the Customer (in particular PDF, as well as image files), identifies the symbology, measures the X-dimension, magnification and quiet zones, and checks these against the GS1 General Specifications, reporting the result as Pass, Review or Fail with an indication of the correction required. EAN-13, EAN-8, UPC-A, UPC-E, ITF-14 and GS1-128 are supported; DataMatrix and QR are detected. The Customer’s files are processed entirely locally on their device; they are not transferred to the Provider’s servers.
  2. The free tier checks the first file and, for PDF files, the first PDF page. The full version enables checking of all PDF pages, batch processing of multiple files and PDF reports. The free version may be used for an unlimited time.
  3. Use requires a current browser. The supported browsers are described on the product page.
  4. Measurement results relate to the geometry contained in the file. For vector artwork, the X-dimension is measured from the actual bar geometry; for a barcode embedded as a raster image, the measurement is limited by pixel resolution and is labelled accordingly. Barcode Medic does not modify the Customer’s file and is not a full verifier under ISO/IEC 15416 (which requires a calibrated hardware scanner on the printed item). The Customer must check the result before approving it for print, in accordance with standard professional practice; the Customer is responsible for the suitability of the artwork and printing process.

§ 4 Rights of Use (Licence)

  1. Upon full payment, the Customer receives a perpetual, non-exclusive right to use the full version of Barcode Medic, major version 1 (v1.x), for their own purposes, including commercial purposes.
  2. The licence key is tied to the email address provided at purchase and may be used on all devices that the Customer personally uses.
  3. The following are not permitted: sharing, reselling or publishing the licence key; bypassing the licence check or the free-tier limits.
  4. Results created with the software (inspection reports, exported reports) belong to the Customer; the Provider has no rights in them. Third-party rights in the inspected artwork remain unaffected.
  5. Updates within major version 1 are included in the purchase price. There is no entitlement to new major versions or new features.

§ 5 Right of Withdrawal and Refunds

Consumers have the statutory right of withdrawal as set out in the withdrawal instructions. Independently of this, the Provider offers a voluntary refund commitment: a full refund within 14 days of purchase, without giving a reason (details on the withdrawal and refund page).

§ 6 Warranty

  1. The statutory provisions on liability for defects in digital products apply (§§ 327 et seq. BGB).
  2. The Provider supplies updates necessary to maintain the software’s conformity with the contract during the relevant period (§ 327f BGB).
  3. The characteristics of the software are defined by the service description in § 3 together with the product page and documentation. In particular, there is no guarantee that every possible file can be read, that a barcode will be found in every file, or that a barcode embedded as a raster image can be measured precisely; unreadable files and barcodes that are not found are indicated by a clear message.

§ 7 Liability

  1. The Provider has unlimited liability for intent and gross negligence and for damage arising from injury to life, body or health.
  2. In cases of ordinary negligence, the Provider is liable only for a breach of essential contractual obligations (cardinal obligations); in this case, liability is limited to foreseeable damage typical of the contract.
  3. Liability under the German Product Liability Act remains unaffected.
  4. The Customer must check the inspection result before approving it for print, in accordance with standard professional practice; a printed run cannot be undone.

§ 8 Availability

After loading, the application runs entirely locally and can also be used offline as an installable app (PWA). The Provider is not obliged to ensure uninterrupted website availability; website interruptions due to maintenance or faults do not affect local use of installed instances.

§ 9 Final Provisions

  1. The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not deprive them of the protection of mandatory provisions of the law of their country of habitual residence.
  2. If the Customer is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction is the Provider’s place of business.
  3. If any provision of these Terms and Conditions is invalid, the validity of the remaining provisions is unaffected.
